As far as I can tell, this is a publisher issue and not ScummVM's.
LIke I mentioned above, Riven on Steam uses ScummVM (a newer version than LSL2 does) and does not use a bat file to run ScummVM with Riven, and thus Steam overlay works for it.

A publisher probably simply has to package their game with a newer version of ScummVM, and avoid the use of a bat file, choosing a custom exe (preferably one that would accept ScummVM command line switches and parameters) or if possible a shortcut (as I did in the workaround).
