There is a difference between using a (closed source) decompressor provided by RAD tools free of charge and rewriting and releasing it under the GPL. There's another thing: IIRC, Toonstruck is shock full of Smacker videos. And I don't think RAD Game tools changed their views about having their formats RE'd. Granted, the ffmpeg-project already did and I at least didn't hear of any uproar about it, but still... if ffmpeg-project includes the code ...
