you should only have to hold L once. Then scummvm will save that setting to SRAM, and upon rebooting, the M3 should save it to the .DAT file.
So it needs a .DAT file. That means you'll have to use game manager (use the direct copy option) to put the scummvm file on your card.

I don't have the floppy version, all I have available is the CD version.
Try the floppy version. It has the same graphics, but not full-speech. Snip

Beware of the "hidden costs" though. For a DS, you need to buy flash card and stuff to be able to play homebrews. (as far as I know) For the psp you have to buy a memory stick (I recommend 1 or 2 GB). Good point. Homebrew on the PSP is free yes, but it does have a downside. If you want to...

Strange. It should work, the steps are correct.

Which version of scummvm are you using?
also, try to run the file with the pc version of scummvm. does that one too say cannot detect?
and did you hold L at the first scummvm startup to enable the m3 driver?

First make sure you have copied the right files. See http://www.scummvm.org/documentation.php?view=datafiles
Then add the game in SCUMMVM. You'll only see folders when browsing to the game, it won't display files. So just go to the folder and add it. Scummvm should detect the game and add it.

Did you use the game manager to copy it? it needs a .dat file to save the sram data (with the M3 setting) to.
